How Federal Sentencing Works

Federal sentencing is governed by the U.S. Sentencing Guidelines, a set of rules created by the U.S. Sentencing Commission. Judges consider the offense level (based on the type and severity of the crime), specific offense characteristics, adjustments, and the defendant's criminal history category (I through VI) to determine a guideline range.

Since United States v. Booker (2005), the guidelines are advisory rather than mandatory, but judges must still calculate and consider them. Departures and variances are possible based on the factors in 18 U.S.C. §3553(a).
